Tampa, Florida Premises Liability Lawyers :: Two Adults Injured When Apartment Stairway Collapsed

Two individuals suffered non-life threatening injuries Tuesday night when a wooden staircase between the first and second floor gave way at a Palm River apartment complex.

Hillsborough County Fire Rescue transported the two adults to a local hospital, according to the St. Petersburg Times.

A ladder truck escorted four adults, three infants and one family dog safely off of the second floor.

County code enforcement is further exploring how the collapse happened.

According to a Harvard University renter demographics study, 80 percent of Americans aged 29 and under rent homes. While the number of renter’s shows a trend of declining with age, 4.1 million households aged 65 and above fall within the home renter category. Property owners are responsible for injuries that occur on their property such as negligence or communication errors on their part. Any person or organization that owns a property has a legal obligation to keep the area free from hazards or notify the public if there is a hazard that cannot be fixed right
away.

Property owners have a duty to provide reasonable accommodations for tenants and to examine, preserve and restore all dangerous areas routinely. In this case, the two injured adults could possibly file a premises liability lawsuit against the apartment complex owners for the negligence of maintaining the property. Since the adults were sent to the hospital for suffering injuries, whether they are permanent ones or not, they could be compensated for any medical expenses, lost wages and any additional pain and suffering that is endured.

Pasco County, FL Negligent Security Attorney News Update: Land O’Lakes, Florida Teenager Killed Outside Clubhouse

The St. Petersburg Times is reporting that a 17-year-old young man was shot and killed during a party at the Lake Padgett Estates, in Land O’Lakes, FL. The 2:00 a.m. shooting occurred allegedly in a parking lot outside of the evening festivities.

The information reported indicates that a group had gathered outside of the development clubhouse, specifically in the parking lot. It is unknown what the Pasco County housing development knew with respect to any other criminal activity in the area. This shooting may open up the development to liability in the form of a Premises Liability action or what is coined a Negligent Security lawsuit.

Negligent Security actions are most commonly found in parking lots out front of clubs or convenient stores where criminal activity is known to be a problem in the area. Florida law obligates property owners to create safe environments and avoid foreseeable risks for their guests. The most obvious way for owners to help themselves and their customers can be simply to employ security and install cameras – but unfortunately many do not. The Pasco County Sheriffs Office continues to investigate and may make an arrest in this case.

Hernando County Premises Liability Lawyer News Update: Weeki Wachee Springs Tram Overturns – Injuring At Least Two

The tram located at historic Weeki Wachee Springs Amusement Park, located just outside Spring Hill, Florida, sent at least two away with injuries on Saturday. The tram is called The Mermaid Express in honor of the well known Mermaids who perform at the park.
According to news reports from Hernando Today reporter Tony Marrero, two of the three tram cars over turned. The injuries sustained by at least two of park’s visitors included a gash to the elbow and bruises to the arm. Due to severity of the accident, at least one of the injured victim’s was transported to the hospital.

Unlike personal injuries sustained in an auto accident, any type of injury sustained in a premises liability action does not need to be permanent in order to receive compensation for pain and suffering. Different types of Premises Liability actions can include a Slip and Fall, Hazardous Materials, Damaged Parking Lots, Unfilled Holes, Drowning, Electrocution and Electrical contact, etc.
