What You Need to Know About Wrongful Death Claims from Car Accidents

Insurance companies are unlikely to advise victims’ relatives that they can file a wrongful death claim following a deadly accident. A wrongful death claim seeks financial compensation for the families of those killed in car accidents. While money cannot bring back a loved one, if someone’s negligence or carelessness resulted in your loved one’s death, they should be held accountable for the financial harm caused. These claims must be made by the surviving family members of the accident victim.

There is also a time frame for which these claims must be filed. In the state of Florida, the statute of limitations is two years from the date of the death. If you miss this time frame, then you may be unable to seek financial compensation.

What Types of Damages Can Be Awarded to Surviving Family Members?

According to Florida law, surviving family members may pursue damages for both economic and noneconomic losses, such as:

  • Costs associated with burial and funerals
  • Loss of your loved one’s financial support system, including salary and benefits from their job
  • Psychological distress
  • Emotional anguish
  • Loss of companionship, moral support, or intimacy

Various damages could be awarded based on the specifics of the case. Based on the losses incurred by the deceased’s remaining family, a jury can determine what is fair.
